Terms and Conditions
JDC Painting Inc. Residential Painting and Drywall Repair Services
Effective Date: 01/01/2025
Scope of Work
JDC Painting Inc. agrees to perform painting, drywall repair, and associated services as detailed in the provided estimate or work order. Any work outside the defined scope will require a written change order and may incur additional charges.
Estimates and Pricing
Estimates are valid for 30 days unless otherwise stated. Final pricing may change if site conditions differ materially from those initially evaluated (e.g., hidden water damage or additional surface preparation requirements). Any changes to materials, colors, or scope after the project begins may affect the total project cost.
Scheduling and Access
Project scheduling is based on availability. Clients are responsible for providing access to the property during normal working hours and must ensure that all work areas are clear of furniture, decorations, and fragile items. JDC Painting Inc. is not responsible for any damage to personal property that was not removed or properly protected by the client.
Payment Terms
A deposit of 15% is required to schedule the project. The remaining balance is due upon substantial completion of the work. Payments may be made via cash, credit/debit card, or bank transfer. Late payments may incur a fee of $5 per day beyond the due date.
Warranty
JDC Painting Inc. offers a 1-Year Limited Paint Warranty covering defects in workmanship. This warranty does not cover damage resulting from structural shifts, settling, moisture, mold, mildew, excessive weather exposure, accidents, misuse, lack of proper maintenance, or normal wear and tear. Damage caused by the client is also excluded.
Surface Conditions
JDC Painting Inc. is not responsible for adhesion problems arising from pre-existing conditions (e.g., water damage, old or improperly prepared surfaces). We will recommend appropriate repair solutions; however, final decisions made against these recommendations may void certain aspects of the warranty.
Changes and Additional Work
Any deviation from the original scope (e.g., color changes, added rooms, additional drywall repairs) must be documented and approved by both parties. Additional work will be billed separately at a mutually agreed-upon rate.
Client Responsibilities
Clients must disclose any known hazards, including lead paint, asbestos, or structural issues. Clients are also responsible for removing valuable or delicate items from the work area prior to the commencement of the project.
Cancellation Policy
Cancellations made more than 48 hours before the scheduled start date will incur no penalty. Cancellations made within 48 hours may result in forfeiture of the deposit.
Limitation of Liability
JDC Painting Inc.’s liability for any claim related to work performed is limited to the amount paid for the services provided. We are not liable for any indirect, incidental, or consequential damages.
Force Majeure
JDC Painting Inc is not responsible for delays or inability to complete the project due to events beyond our control, including but not limited to acts of God, natural disasters, supply shortages, or labor disputes.
Governing Law
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law principles.
Acceptance
By accepting a quote, signing an agreement, or allowing work to commence, the client agrees to these Terms and Conditions in full.
